Floyd Still Needs Approval of Kelly, St. Joseph's County

Despite a huge "victory" Friday afternoon, Michael Floyd's status is still unknown and will be most likely remain unknown until early to mid-May when Floyd ultimately appears in court. It appears the reaction has been to quickly believe that this situation is over and Floyd will play for Notre Dame in the fall without suspension. However, Brian Kelly still may suspend Floyd for certain number of games and Floyd may face a harsh legal punishment for his third alcohol related offense.

Tomorrow, Notre Dame will ultimately find out what Brian Kelly's response to the situation will be. It seems likely that Kelly will not suspend Floyd and follow the punishment placed by Notre Dame's disciplinary wing Residence Life. However, Kelly has the power to suspend Floyd for between one game to an entire season. Kelly's reaction may be to send a message to his team and suspend Floyd but that seems unlikely.

In May, Floyd will be in front of St. Joseph's county court. It is unknown what the precedent for a person in his position would be facing. It seems like an diversion program or community service would be the punishment for Floyd. According to a legal website, Floyd could expect probation, payment of restitution, a license suspension, payment of court costs, and could face jail time, because his blood alcohol level was .19%, in the state of Indiana.

If Floyd passes the approval of Coach Kelly and St. Joseph's county court, he will most likely rejoin the Irish football program this summer. On the football side of this decision, Notre Dame obviously needs Floyd to reach that next level. However, Notre Dame will lose the PR battle if Floyd is not suspended for multiple games. The reaction by college football fans has been to criticize Notre Dame for claiming to hold themselves to a high standard of ethics than the rest of college football.
